I hereby agree to the following: 1. I am participating in classes or services during which I will receive information and instruction about yoga and health. I recognize that yoga requires physical exertion, which may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved. 2. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in any physical fitness program, including yoga. I represent and warrant that I have no medical condition that would prevent my participation in physical fitness activities. 3. In consideration if being permitted to participate in the yoga classes, I agree to assume full responsibility for any risks, injuries or damages, known and unknown, which I might incur as a result of participating in the program. 4. In further consideration of being permitted to participate in the yoga classes, or private sessions, I knowingly, voluntarily, and expressly waive any claim I may have against the instructor, the owner, or the leaseholder of the building for injuries or damages that I may sustain as a result of participating in classes, workshops, trainings, or private sessions. 5. I hereby grant permission to use my likeness in a photograph, video or other digital media in any and all of it’s publications, including web-based publications and marketing without payment or other consideration. 6. I am aware of the existence of the risk on my physical appearance to the venue and my participation to the activity with Dana Damara Evolution public sessions that may cause injury or illness such as, but not limited to Influenza, MRSA, or COVID-19 that may lead to paralysis or death, and am therefore fully and personally responsible for my own safety and actions. 7. With full knowledge of the risks involved, I hereby release, waive, discharge Dana Damara Evolution, Alila Marea, its teachers, and employees from any and all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by me related to COVID-19 while participating in any activity while in, on, or around the premises or while using the Facilities that may lead to unintentional exposure or harm due to COVID-19 8. I agree to indemnify, defend, and hold harmless Dana Damara Evolution from and against any and all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to any and all claims made by or against Dana Damara Evolution due to injury, loss, or death from or related to COVID-19. 9. I have read and fully understand and agree to the above terms of this Liability Waiver Agreement.
